POSITION
The Department supports
this statute as enrolled.
PROBLEM/BACKGROUND
In an era of budget
difficulties, various proposals to sell off state-held assets may be introduced
in order to balance budgets or fund a variety of proposals. This statute represents an effort to ensure
that state park lands cannot be deemed "surplus" and, thus, be made
available for sale without a significant notification, review and approval
process as identified in statute section 74102b.
DESCRIPTION OF BILL
SB 972 seeks to amend
section 2131 of PA 451 by adding to the Land Exchange Facilitation Fund (LEFF)
statute that the Department shall not designate land within a state park as
surplus.
SUMMARY OF ARGUMENTS
Pro
Protects state park and
recreation area lands from sale by prohibiting the designation of such lands as
“surplus" without a thorough review and approval process.
Con
This statute will
delay and complicate any proposed land transaction involving state park and
recreation area lands.
